PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of habeas corpus directing the respondents 1 to 3 to produce the body or person of petitioner's granddaughter detenue namely Deepika, daughter of Kannan, aged about 19 years, before this Court and set her at liberty.

O R D E R

[Order of the Court was made by K.KALYANASUNDARAM, J.] The petitioner has filed the habeas corpus petition seeking a direction to the respondents 1 to 3 to produce the detenue viz., her granddaughter Deepika, daughter of Kannan, aged about 19 years, before this Court and set her at liberty.

2. When the matter was taken up for hearing, the learned Additional Public Prosecutor for the respondents 1 to 3 submitted that the detenue Deepika and the fourth respondent appeared before the respondent Police and they have stated that Deepika is a major. Further, the learned Additional Public Prosecutor would state that the alleged detenue was produced before the Principal District Munsif-cum-Judicial Magistrate, Karaikudi and she gave a statement https://hcservices.ecourts.gov.in/hcservices/ 1/2

H.C.P.(MD) No.398 of 2020 to the effect that she is aged about 20 years and she left the home on her own volition and married the fourth respondent and she expressed her willingness to go along with the fourth respondent.

3. The learned counsel for the petitioner would submit that the fourth respondent is in the habit of kidnapping the minor girls and already he is facing criminal cases.

4. However, in the light of the above facts, no further orders are necessary in this habeas corpus petition and the same is, therefore, closed.
