Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, forbearing the second respondent not to interfering in the civil dispute between the petitioner and the third and fourth respondents which is the subject matter of the suit in O.S.No.146 of 2010 on the file of the 1st Additional District Munsif Court, Nagercoil based on the representation dated 20.04.2021.

ORDER

This Writ Petition has been filed to forbear the second respondent not to interfering in the civil dispute between the petitioner and the third and fourth respondents which is the subject matter of the suit in O.S.No.146 of 2010 on the file of the 1st Additional District Munsif Court, Nagercoil, based on the representation dated 20.04.2021.

2. When the matter was taken up for hearing on 03.08.2021, the learned Additional Public Prosecutor submitted that on the basis of the complaint given by the fourth respondent, enquiry was undertaken in proceedings No.P2/SP/827/2021 and it was closed on 31.07.2021 https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.8598 of 2021 by advising the parties to resolve their disputes before the Civil Court or by measuring the property with the help of Surveyor.

3. For the purpose of circulating the copy of the closure report, the matter is listed today. On perusal of the closure report, it shows that advise has been given to the parties to measure the property with the help of Surveyor or resolve their disputes before the Civil Court. Since the complaint itself has been closed, nothing survives for further consideration or directions.

4. Accordingly, this Writ Petition stands disposed of as infructuous.
