ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. 2.The petitioner complains that the respondents have breached the order passed by this Court on 31.01.2023 made in W.P(MD)No.1771 of 2023. After going through the materials on record, I am more than satisfied that the respondents have not committed any breach of the order passed by this Court. Notice dated 09.03.2023 was issued proposing to hold survey on 29.03.2023. In other words, the survey authority has given sufficient time to the parties concerned. If the petitioner had any objection, he must have put it in writing and filed the same before the first respondent. A copy of the so-called objections dated 09.03.2023 has been enclosed in the typed set of papers. I went through the same. I do 2/4

not find raising of any material point in the same. Therefore, the authority cannot be faulted for having come to this spot for conducting survey this morning. The conduct of the respondents cannot be faulted. If the petitioner has raised anything of substance, the Tahsildar would definitely be obliged to go into the same. When the petitioner has virtually raised nothing, the authority cannot be blamed. This contempt petition stands closed.
