O R D E R
This Criminal Original petition is filed by the petitioner, to transfer the investigation in Crime No.159 of 2017, dated 03.04.2017 from the file of the 3rd Respondent herein to any other independent agency preferably CBCID, with a direction to complete the investigation within a time frame.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Criminal side) appearing for the respondents.
3.The petitioner has come forward with this petition alleging certain inaction on the part of the third respondent. The learned counsel for the petitioner submitted that there is a delay in every stage of the investigation due to the inefficiency and inaction on the side of the third respondent. stand by complaining about the third respondent about his inefficiency and now he has presumed that the third respondent has colluded with the accused to drag on the investigation.
4. On instructions, the learned Additional Public Prosecutor has placed before this Court the information furnished by the third respondent as to the filing of charge sheet in this case. According to him, the charge sheet was already filed and the same was taken on file in C.C.No.177 of 2017 by the learned Judicial Magistrate, Tirumangalam.
5. Having regard to the said statement of the learned Additional Public Prosecutor, this Court is of the view that no further enquiry is required in this matter.
6. As a result, this Criminal Original Petition is dismissed. However, it is open to the petitioner to seek appropriate remedy, incase he is not satisfied with the final report and the matter required any further investigation.
