Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents to pay medical bill of Rs.4,81,880/- to the petitioner payable under New Health Insurance Scheme 2018 for reimbursing Medical Expenditure incurred by the petitioner's wife suffering from Carcinoma Endometrium disease with interest at the rate of 12% and pass such further or other orders as this Court may deem fit and proper in the circumstances of the case and thus render justice. Heard the learned counsel on either side.

2.The petitioner is a Senior Citizen. He was employed as school teacher. His wife underwent surgery for breast cancer. Originally, the third respondent had recommended that the petitioner's claim for reimbursement must be honoured by the insurer. Later, it turned out that it was a case of nonemergency and that treatment was taken in a non-network hospital. The petitioner is based in Dindigul. Treatment was taken in Coimbatore. In these circumstances, the sixth respondent cannot be fastened with liability. The 2/4

petitioner's case will have to be considered as per the Tamil Nadu Medical Attendance Rules. The fourth respondent is directed to forward the papers to the first respondent. The first respondent will process the claim and make payment to the petitioner as per the eligibility norms. This shall be done within a period of twelve weeks from the date of receipt of copy of this order. 3.This writ petition is disposed of with the aforesaid direction.
