PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to direct the respondents 1 & 2 to instruct the 4th and 5th respondents to take necessary action against the 6 and 7 respondents on the petitioner's complaint dated 05.03.2026, within stipulated time may be framed by this Court.

ORDER

This petition has been filed seeking for a direction to the respondents 1 & 2 to instruct the 4th and 5th respondents to take necessary action against the respondents 6 & 7 on the petitioner's complaint dated 05.03.2026, within stipulated time may be framed by this Court.

2. The learned counsel for the petitioner submitted that the petitioner had lodged a complaint as against the 6th and 7th respondents with respect to the fraudulent document which has been created by them. However, no action has been taken and hence, this petition came to be filed. 2/6

3. The learned Government Advocate, Mr. M. Sakthi Kumar, submitted that the dispute pertains to 21⁄2 cents of land comprised in Survey Nos. 98/1C, 98/1D and 100/2A, situated at Teppakulam, Madurai, within the jurisdiction of the Sub Registrar Office, Madurai South, covered under Document No. 625 of 2026 dated 13.01.2026. The petitioner had purchased the said property from one Eshwarlal. It was further submitted that the petitioner's vendors had earlier lodged a complaint against respondents 6 and 7 alleging fabrication of certain documents, pursuant to which an FIR in Crime No. 17 of 2026 was registered on 19.02.2026 by the Central Crime Branch, Madurai City. Subsequently, on 04.03.

2026, the accused persons are alleged to have trespassed into the petitioner's property and removed certain construction materials, following which the petitioner lodged a complaint before the Commissioner of Police, Madurai City, which was forwarded to the fifth respondent on 10.03.2026. It was also submitted that a summons had been issued to the petitioner to appear for enquiry today; however, the petitioner, without attending the enquiry, has approached this Court.

4. Heard the learned counsel on either side and carefully perused the materials available on record. Since no adverse order is proposed to be passed against the private respondents, notice to them is dispensed with. 3/6

In view of the fact that an enquiry has already been initiated and is in progress by the fifth respondent police, and that summons has also been issued, the petitioner is directed to appear before the fifth respondent police and produce all necessary records substantiating his claim. It is further made clear that respondents 6 and 7 shall also be issued summons under Section 64 of the BNSS. The fifth respondent police is directed to conclude the enquiry as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order. The fourth respondent is also directed to monitor the enquiry conducted by the fifth respondent.

6. With the above direction, this writ petition stands disposed of. 12.03.2026 NCC : Yes / No Index : Yes / No sm 4/6
