PRAYER : Writ Original Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to permit the petitioner to conduct the cultural function viz. Sri Valli Thirumana Nadagam during the temple festival of Arulmighu Sri Sonaiyakkaruppar and Sri Vithinikaliamman Kovil, Kalapangudi Village, Kannangudi Post, Devakkottai Taluk, Sivagangai District on 23.06.2018 from 09.00 P.M., to 06.00 A.M., and further direct the respondents to give adequate police protection for the above said programme by considering petitioner's representation dated 02.04.2018.

This Writ Petition has been filed to direct the respondents to permit the petitioner to conduct the cultural function viz. Sri Valli Thirumana Nadagam during the temple festival of Arulmighu Sri Sonaiyakkaruppar and Sri Vithinikaliamman Kovil, Kalapangudi Village, Kannangudi Post, Devakkottai Taluk, Sivagangai District on 23.06.2018 from 09.00 P.M., to 06.00 A.M., and further direct the respondents to give adequate police protection for the above said programme by considering petitioner's representation dated 02.04.2018.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3.When the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents, on instructions, would submit that the petitioner has mentioned in the petition that he is the President of the Festival Committee of the temple, but, he has not mentioned in the representation. However, he has mentioned as "Vizha Committee Thalaivar" only by hand-writing in the representation copy filed in the typed set of papers. Therefore, the prayer sought for by the petitioner in this writ petition cannot be granted. Hence, the writ petition is liable to be dismissed as not maintainable.

4.In the result, this writ petition is dismissed as not maintainable. No costs. However, liberty is given to the concerned President or organizer or representative of the Festival Committee to make a fresh representation to the respondents, if so advised.
