ORDER : The Court Made the following order :- The petitioners/A3 to A5 and Petitioners/A1 to A4, who were arrested and remanded to judicial custody on 15.11.2016, for the offences punishable under Sections 147, 148, 294(b), 324 and 307 of

Indian Penal Code and under Section 3 of TNPPDL Act in Crime Nos.880 & 881 of 2016 respectively, on the file of the respondent police, seek bail.

2. The case of the prosecution is that due to previous enmity, the accused attacked the defacto complainant with deadly weapons like Aruval, wooden log and trespassed into the house of the defacto complainant and damaged the house hold articles worth about Rs.5000/-.

3. The learned counsel for the petitioner would submit that it is a case of case in counter. He would further submit that the petitioners are innocent and they have been falsely implicated in this case.

4. The learned Government Advocate (crl.side) submitted that it is a case of case in counter. He would further submit that due to previous enmity, the accused attacked the defacto complainant with deadly weapons and also trespassed into the house of the defacto complainant and damaged the house hold articles worth about Rs.5000/-. He also submitted that the injured has been discharged from the hospital.

5. Considering the above facts and circumstances of the case, I am inclined to grant bail to the petitioners subject to certain conditions.

6. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand Only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Sivagangai and on further condition that:

[a] the petitioners shall report before the learned Judicial Magistrate No.1, Sivagangai, daily at 10.30 a.m., until further orders.

[b] the petitioners shall not tamper with evidence or witness either during investigation or trial.

[c] the petitioners shall not abscond either during investigation or trial.

[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law, as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. sd/- 05/12/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
