ORDER

The writ petition is filed to quash the impugned refusal check slip issued by the second respondent in his proceedings in Refusal Number R.F.L./Kannivadi/4/2025 dated 21.02.2025 and direct the second respondent to register the release deed presented by the petitioner having application No.S01LANDVV202502105422204 dated 10.02.2025. 2.The issue raised in this writ petition is squarely covered by the Judgment of this Court in T.Senthilvel vs. District Registrar (Administration), Dindigul District and others, W.P.(MD).No.22114 of 2024 dated 17.10.2024. The Hon'ble Mr.Justice N.Sathish Kumar held that merely because there is a double entry in respect of the subject property, registration cannot be refused. The learned Single Judge further held that the fact that there are multiple entries for the very same survey number by the multiple persons does not empower the sub registrar to reject the document presented for registration.

Therefore, following the said Judgment in T.Senthilvel vs. District Registrar (Administration), Dindigul District and others, W.P.(MD).No. 22114 of 2024 dated 17.10.2024, the writ petition is allowed. The impugned proceedings issued by the second respondent in Refusal Number R.F.L./Kannivadi/4/2025 dated 21.02.2025 is quashed. The second respondent is directed to register the release deed presented by the petitioner having application No.S01LANDVV202502105422204 dated 10.02.2025 within a period of two weeks from the date of uploading of this order. It is made clear that the mere fact that the document has been registered by the writ petitioner does not mean that the right has been conferred on him.
