Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 302 and 341 of I.P.C., in Crime No.403 of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent police.

3. The case of the prosecution is that due to previous enmity, on 14.11.2016, at about 8.30 p.m., the petitioner along with the other accused said to have brutally attacked the de-facto complainant's son with weapons and committed the murder.

4. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that only on the basis of the confession statement given by A4, the petitioner has been implicated in this case and he was not present at the scene of occurrence.

5. The learned Government Advocate (Crl.side) would submit that except this petitioner, almost all the accused have been arrested.

6. Taking note of the fact that except this petitioner, almost all the accused have been arrested and the incident said to have taken place on 14.11.2016, this Court is not inclined to grant https://hcservices.ecourts.gov.in/hcservices/

anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
