PRAYER :-Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to set aside the impugned communication dated 22.12.2022 vide Ref. 010600/G/2682/2022 issued by the 5th respondent and further direct the 3rd and 5th respondent to consider petitioner husband medical reimbursement claim which made in 2016 upon the death of her husband and pay the same immediately to the petitioner. ORDER

Heard Mr.V.Rajiv Rufus, learned counsel for the petitioner, Mr.J.Ashok, learned Additional Government Pleader, for the respondents 1 to 4 and Mr.A.Shahjahan, learned counsel for the respondents R5.

The petitioner has filed this writ petition challenging the order of the 5th respondent dated 22.12.2022 and for a consequential direction to the 3rd and 5th respondents to consider petitioner's husband's medical reimbursement claim, which was made in 2016 upon his death and pay the same immediately to the petitioner.

3. The grievance of the petitioner is that every time she produces the required documents, she has been asked to produced the same documents once again and one such communication was received by the petitioner from the third respondent.

4. From the representation made by the learned counsel for the petitioner, it is seen that the papers have been submitted to the third respondent/Joint Director. In such case, the third respondent has to forward the necessary papers along with the earlier papers filed by the petitioner, if any, to the 5th respondent to enable the 5th respondent to consider the claim of the medical reimbursement in the light of the scheme governing the same.

5. The third respondent is directed to forward the papers to the 5th respondent within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the 5th respondent shall pass proposal in accordance with the scheme within a period of four weeks thereafter.

6. The writ petition is disposed of with the above direction. No costs.
