Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to renew the Passport No.T1477318 of the petitioner's minor son Hariharagopalan Kannan, based on his application, pending before the 1st respondent in File No.MD2077050977124.

ORDER

The petitioner is the father of minor Hariharagopalan Kannan. There is a long standing dispute between the petitioner and his wife - second respondent.

2. Admittedly, the petitioner's minor son was in the custody of the petitioner. He also studied in Singapore. Subsequently, due to some unavoidable circumstances, he has discontinued and hence, now the petitioner seeks to renew the Passport of his minor son for pursuing further education in Singapore, which has been averred in the writ petition and also not disputed by the other side. The second respondent has also not taken any steps to take custody of the minor child namely, Hariharagopalan Kannan.

3. In view of the above facts and circumstances of the case, this Court directs the first respondent to renew the Passport No.T1477318 of the petitioner's minor son - Hariharagopalan Kannan, based on his application in File No.MD2077050977124 within 2 weeks from the date of receipt of a copy of this order.

4. Writ Petition is allowed. No costs.
