PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.201 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/A.2, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 324 and 307 IPC, in Crime No.201 of 2021, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and other accused abused the defacto complainant in filthy language and when the same was questioned by the defacto complainant, the first accused attacked him with knife and also the petitioner and other accused threatened him with dire consequences. Hence, the complaint. 3.The learned Government Advocate (Criminal Side) would submit that the learned Principal Sessions Judge, Pudukottai, has granted bail to the petitioner in Crl.M.P.No.4693 of 2021 vide order dated 19.11.2021 and subsequently the learned Principal Sessions Judge has passed an order dated 25.01.2022 in Crl.M.P.No.295 of 2022 cancelling the bail.
4.Since the learned Principal Sessions Judge has cancelled the bail, the question of granting anticipatory bail does not arise. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.7264 of 2022 5.At this juncture, the learned counsel for the petitioner would submit that liberty may be given to the petitioner to challenge the said order.
6.Accordingly, this Criminal Original Petition is dismissed with liberty to the petitioner to take necessary proceedings to challenge the impugned order.
