The petitioner has filed this criminal original petition, under Section 482 of the Code of Criminal Procedure, seeking direction upon the first respondent to nominate the second respondent to enquire into the matter, based on her complaint, dated 26.12.2015, and to register a case against the respondents 3 and 4 within a stipulated period.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.
3. It is seen that based on the complaint lodged by the petitioner's father, a woman missing case, in Crime No.359 of 2015, was registered by the respondent Police, on 17.12.2015, and the petitioner was secured and she was produced before the concerned jurisdictional Magistrate. Thereafter, she has alleged that the respondent Police have acted in a high handed manner. It is seen that when the petitioner was produced before the concerned jurisdictional Magistrate, she never made any allegation against the https://hcservices.ecourts.gov.in/hcservices/
respondent Police. Under such circumstances, no positive direction can be given to the respondent Police to register a case. Accordingly, this criminal original petition is dismissed. However, the petitioner is at liberty to work out her remedy in the manner known to law.
