ORDER

This petition has been filed to direct the respondent herein not to harass the petitioner under the guise of enquiry, regarding the false and vexatious complaint given by Sandhya, wife of the petitioner, except by observing due process of law.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

3. The learned counsel for the petitioner would submit that the respondent Police frequently called the petitioner to the Police Station and harassed him under the guise of enquiry in respect of a matrimonial dispute.

4. The learned Government Advocate (Criminal Side)on instructions, would submit that the petitioner was called only for enquiry in respect of a complaint given by his wife one Sandhya as against him and based on the complaint, a case has been registered in Crime No.7 of 2016, and the petitioner is an accused in the said Crime No.7 of 2016. He further submitted that the respondent Police did not cause any harassment to the petitioner. However, he gave an undertaking that if at all the presence of the petitioner is required, the respondent would call the petitioner for enquiry only after issuing summons giving specific date, time and place.
