ORDER
This Writ Petition is filed to issue a Writ of Mandamus, forbearing respondents 1 and 2 from interfering the in civil dispute covered by civil suit in O.S. No.1/2026 on the file of the District Munsif Court, Pattukottai in respect of S.No.1/3 in ward-B, Block-32 and T.S.No.24/9, the private lane proceeding from Maniyarpuram Municipality Road, Pattukottai Town and Taluk, Thanjavur District.

Learned counsel for the petitioner submitted that a civil dispute prevails between the petitioner and the third respondent pursuant to which O.S.No.1 of 2026 has been filed by the petitioner before the learned District Munsif, Pattukottai, as against the third respondent. Having filed vakalat in the said civil suit, the third respondent is interfering with the petitioner's property, and on receipt of a complaint from the third respondent, the second respondent police is unnecessarily meddling in the civil dispute. Hence this writ petition.
3. Learned Government Advocate(Crl.side) submitted that CSR No.653/2025 has been registered on the complaint given by the third 2/5
respondent and they have obtained legal opinion from the Public Prosecutor of the learned Principal District Judge, Thanjavur District. He further submitted that enquiry is pending on the complaint.
4. Heard both sides and perused the materials available on record.
5. It is seen that a suit in O.S.No.1 of 2026 on the file of the learned District Munsif Court, Pattukottai, between the petitioner and the third respondent. Though the learned Government Advocate submitted that already legal opinion has been obtained from the Public Prosecutor of the learned Principal District Judge, Thanjavur District, in this regard, this Court is of the considered view that if the second respondent police is able to make out from the facts and circumstances of the case is that the dispute involved between the petitioner and the third respondent is exclusively with respect to the subject property of OS No.1 of 2026 on the file of learned District Munsif, Pattukottai, the second respondent is directed not to meddle with the civil dispute. 3/5
6. With the above direction, this Writ Petition is disposed of. No costs.
