ORDER
By an order dated 04.04.2025, I directed Mr.S. Raja, Standing Counsel, for the respondent, to deposit a sum of Rs.4,38,128.50 to the credit of MCOP No.20 of 1995 on the file Motor Accident Claims Tribunal-cum-Subordinate Judge at Periyakulam. This being the amount that the respondent is liable to pay, pursuant to the order and decretal order in MCOP No.20 of 1995 dated 16.04.2003 on the file of the said court as confirmed by this court in C.M.A(MD)No.545 of 2005.
2. When the matter was called today, Mr.S.Raja reported that as directed by this court on 05.04.2025, the respondent deposited a sum of 2,17,501/- and on 22.04.2025, the respondent deposited a further sum of Rs.1,68,131/-.
3. Mr.K.Hemaraj sought for a direction to withdraw the amount.
4. As the respondent has deposited the amount, the petitioner shall file an appropriate application before the learned Sub Judge at Periyakulam, for withdrawal of the deposited amounts. If the learned Sub Judge is convinced with the plea of the petitioner that he is the 2/4
legal heir of the deceased Sundharam and he is entitled to the aforesaid sum, he shall pass appropriate orders permitting him to withdraw the amount together with accrued interest. The said exercise shall be completed within a period of eight weeks from the date of filing of the cheque application.
