ORDER

[Order of the Court was made by M.SATHYANARAYANAN, J.] The petitioner made a challenge to the impugned notice dated 28.01.2015 issued by the first respondent, in and by which, permission sought for by the petitioner from the Panchayat Union Council, came to be returned on account of non-furnishing of copies of certain documents.

2. This Court has heard the submissions of Mr.Isaac Mohanlal, learned Senior Counsel assisted by Mr.B.Prasanna Vinoth, learned counsel appearing for the petitioner, Mr.A.K.Baskarapandian, learned https://hcservices.ecourts.gov.in/hcservices/

Special Government Pleader appearing for the first respondent and Mr.C.Selvaraj, learned Standing Counsel appearing for the second respondent.

3. In W.P(MD)No.19069 of 2016, wherein the petitioner herein made a challenge to G.O.(2D)No.91 Housing and Urban Development (Na.va.4(i)) Department, dated 30.06.2016, with other consequential prayers and the learned Single Judge of this Court, has partly allowed the Writ Petition and remanded the matter to the Government, for fresh consideration and in the considered opinion of this Court, the order of remand, covers the issue involved in this Writ Petition also.

4. It is to be noted at this juncture that as against the order dated 26.04.2017 made in W.P(MD)No.19069 of 2016, Writ Appeal (MD)No.976 of 2017, is preferred and it was listed today and arguments have already been advanced in the said Writ Appeal.

5. In the light of the said development, nothing remains for further adjudication in this Writ Petition as on date and therefore, this Writ Petition is closed. No Costs. Consequently, connected Miscellaneous Petition is closed.
