ORDER

This Criminal Original Petition is filed to direct the respondents 2 & 3 to give a adequate police protection to the petitioner's life and limb and to put on land level stone which was illegally removed by the 4th respondent in Survey No.207/7 in extent of 0.1.60 (4 1⁄2 cents) in patta No.1618 (Old Survey No.207.1B1) which is situated at A.Vellode Pirivu, Alamarathu Post, Athur Taluk, Dindigul District on the basis of the petitioner's representation dated 16.04.2021.

2. There is no representation for the petitioner.

3. The learned Additional Public Prosecutor would submit that based upon the complaint given by the petitioner against the fourth respondent and his son, CSR.No.45 of 2021 was registered and they were calling upon for enquiry on 10.04.2021. On the date of enquiry, the petitioner and the fourth respondent and his son appeared before the Enquiry Officer and gave statement that they have to work out their remedy before the Civil Court. On that ground, the compliant was closed.

4. It is also submitted by the learned counsel for the third respondent that the petitioner (*)expired due to Covid - 19. But, no steps were taken to implead their legal heirs.

5. Since the petitioner (*)expired this petition is infructuous as abated.
