O R D E R

The petitioner has filed the present writ petition seeking expeditious disposal of his patta transfer application, dated 27.06.2023.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

3. It is the contention of the petitioner that his father purchased the property under a registered sale deed, dated 29.12.1988 and thereafter, he passed away on 22.04.2011. Subsequent to his demise, as the legal heir, the petitioner has sought for transfer of patta in the name of the legal heirs of his father.

However, when the matter is taken up for admission, the learned Special Government Pleader would submit that though the SLR records reflect the name of the vendor of the petitioner's father, computer patta which has been recently uploaded on 07.02.2016 reflects the name of Nirmala w/o Francis and Anitha w/o Raja in respect of very same survey number.66/4. Therefore, the learned Special Government Pleader would submit that it would not be possible 2/4

for the petitioner's representation to be acted upon in the prevailing circumstances.

In view of the above, the petitioner is given liberty to challenge the patta issued to the said Nirmala and Anitha in Patta No.8232 by making an application before the Revenue Divisional Officer, Thanjavur within a period of four (4) weeks from the date of receipt of copy of this order. The said appeal may be taken by the Revenue Divisional Officer, Thanjavur without raising any issue of limitation. After hearing the petitioner as well as the said Nirmala and Anitha, in whose name patta has been mutated, the Revenue Divisional Officer is directed to pass orders within a period of twelve (12) weeks from the date of receipt of the appeal to be filed by the petitioner.

6. With the above directions, this Writ Petition stands disposed of. No costs.
