ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 354 & 509 IPC and Section 66E and 67A of Information Technology Act, 2000 in Crime No.376 of 2016 on the file of the respondent Police, seek anticipatory bail.
2.The case of the prosecution is that first petitioner is the brother-in-law of the de facto complainant and the 2nd petitioner is the friend of the first petitioner. Due to some family dispute, the petitioners described the de facto complainant as if she is a prostitute in internet and also transmitted to their friends.
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case.
4.The learned Government Advocate (Crl.side) submitted that investigation is pending and she opposed for granting anticipatory bail to the petitioners.
5.Considering the facts and circumstances of the case and also taking note of the fact that serious offence said to have been committed by the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the Criminal Original petition is dismissed.
