PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to survey the land and then issue patta to the petitioners' 41 cents of land out of 1 Acre 32 cents in Old Survey No.307/6 and Re-survey No.307/6A1 in Madakulam Village, Maduria-10 and since it was merged with the Madurai Corporation, as per the Extract of the Town Survey Land Register its Block No. 6-Madakkulam, Survey Field 12, Sub Division -1, transferring the name from the vendor to the petitioners within a time frame of this Hon'ble court in the light of the petitioner's representation dated 03.08.2019 For Petitioner : Mr.D.Ghandiraj For Respondents : Mr.M.Pandiarajan Additional Government Pleader
ORDER
This Writ Petition is filed to direct the respondents to survey the 41 cents of land out of 1 acre 32 cents in old S.No.307/6 (Resurvey No.307/6A1) situated at Madakulam Village, Maduria-10 and to issue a patta in favour of the petitioners.
2.According to the petitioners, they made a representation on 03.08.2019 before the 2nd respondent seeking to survey the 41 cents of land out of 1 acre 32 cents in old S.No.307/6 (Re-survey No.307/6A1) situated at Madakulam Village, Maduria-10 and to fix the four boundaries. But, on such representation no action has been taken by the 2nd respondent till date. Hence, the present writ https://hcservices.ecourts.gov.in/hcservices/ 1/2

3.The learned Additional Government Pleader appearing for the respondents had produced a proceedings of the 2nd respondent in Na.Ka.No.179/2019/S dated 15.07.2020, wherein, it had been stated that after the partition was made in respect of the aforesaid property, the request of the petitioner shall be considered and the aforesaid fact has also been communicated to the petitioners on 16.07.2020.
4.Under such circumstances, the learned Additional Government Pleader would submit that nothing survives for further adjudication in the present writ petition and prays before this Court that the writ petition ought to be dismissed.
5.In view of the submission made by the learned Additional Government Pleader, this Writ Petition is dismissed as infructuous. It is open to the petitioners to challenge the aforesaid order dated 15.07.2020, if they are so advised. No costs.
