Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 t o3 to take immediate action with regard to the issuance of pattas by the 4th respondent dated 12.08.1999 through his proceedings No.Na.Ka.Aha/474/99 and subsequent dates to the ineligible persons for constructing the building under Adi Dravidar Welfare Scheme in respect of lands bearing Survey Nos.19/7,8,9 to an extent of 2 acres and 7 cents situated at Poolangulam Village, T.Kiranthai Group, Kadaladi Circle, Ramanathapuram District and cancel those pattas which are issued illegally and consequently issue patta to the eligible person within the time stipulated by this Court. This Writ petition has been filed seeking a direction to respondents 1 to 3 to cancel the patta granted in favour of various ineligible persons in Survey Nos.19/7,8,9 to an extent of 2 acres and 7 cents situated at Poolangulam Village, T.Kiranthai Group, Kadaladi Circle, Ramanathapuram District. 2.Heard Mr.V.R.Venkatesan, the learned counsel appearing for the petitioner and Mrs.J.Padmavathi Devi, the learned Special Government Pleader appearing for the respondents. 3.According to the petitioner, he belongs to Scheduled Caste community and converted into Christianity, and he belongs Adi Dravidar community, and according to him a free house site patta has been issued to various Adi Dravidar people, in which many eligible persons were granted patta. Hence, he made a representation to the respondents 1 to 3 to take action against them and to cancel the patta. Since, no action has been taken, the present writ petition has been filed.
4.The learned counsel appearing for the respondent submitted that, already third respondent, District Adi Dravida Welfare Officer taken action and issued notice to the various patta holders and now an enquiry is pending and the third respondent will pass suitable orders.
5.Considering the fact that already enquiry has been initiated by the 3rd respondent, the 3rd respondent is directed to complete the enquiry and pass suitable orders on merits after issuing notice to all the persons interested within a period of 12 weeks from the date of receipt of a copy of this order. 6.With the aforesaid directions, this writ petition is disposed of. No costs.
