For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.4 of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/A1 who apprehend arrest at the hands of the respondent Police for the offences punishable under Sections 147,148,294(b) and 307 of IPC in Crime No.4 of 2023 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution is that due to business motive the petitioner along with other accused assembled together and attacked the defacto complainant with deadly weapons, Hence, the complaint.

3. Heard both side and perused the materials available on record including the First Information Report.

4. Taking into consideration the fact that the petitioner is the first accused and he along with other accused brutally attacked the victim, therefore he sustained grievous injuries and still taking treatment in the hospital. That apart the petitioner is a habitual offender and against him six previous cases are pending, https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.5809 of 2023 therefore custodial interrogation of the petitioner is very much required in this case, hence this court is not inclined to grant anticipatory bail to the petitioner.

5. Hence the petition stands dismissed.
