BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 31.07.2015 CORAM :

THE HONOURABLE MR.JUSTICE R.MAHADEVAN Writ Petition (MD) No.13457 of 2015 Christal Jose Vent Kumari ...

Petitioner Vs.

1.The Assistant Treasury Officer, Kalkulam at Thucklay, Kanyakumari District.

2.The District Registrar, Kanyakumari District, Nagercoil.

... Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to supply stamps to the petitioner according to the licence issued to the petitioner bearing serial No.22/2008.

For Petitioner : Mr.C.Godwin For Respondents : Mr.N.S.Karthikeyan, Government Advocate.

ORDER

Heard the learned counsel appearing for the petitioner and Mr.N.S.Karthikeyan, learned Government Advocate for the respondents. By consent, the writ petition itself is taken up for final disposal at the admission stage.

2.The prayer in the writ petition is to direct the respondents to supply stamps to the petitioner as per the licence issued to the petitioner bearing serial No.22/2008.

3.According to the petitioner, the petitioner was granted with stamp vending licence in the year 2008. During the year 2010, due to ill health, the petitioner was not able to continue the stamp vending business operations which caused automatic cancellation of licence under Rule 25 (ii) of the Tamil Nadu Stamp Rules. Thereafter, on 29.11.2010, the petitioner represented with medical certificate for revival of the licence. Due to inaction on the part of the respondents, a reminder was also filed on 30.12.2011. Since the authorities did not consider and pass orders, the petitioner is before this Court. 4.Admittedly, once the licence is getting lapsed for the discontinuance of business operations for one year, the same cannot be revived under Rule 25 (ii) of the Tamil Nadu Stamp Rules. Hence, it is always open to the petitioner to approach the authorities for getting fresh licence, if there is no legal impediment. https://hcservices.ecourts.gov.in/hcservices/

5.With the above observation, the writ petition is disposed of. No costs.
