COMMON PRAYER: Writ Petitions filed under Article 226 of the Constitution of India, to issue a Writs of Mandamus to direct the respondents to issue joining letter to the petitioner in the post of Contable (GD) in CAPFs/NIA/SSF and Rifleman (GD) in Assam Rifles in the year 2018 by considering the petitioners' representation dated 09.04.2022.
(In all WPs) For Petitioners : Mr.D.S.Haroon Rasheed For Respondents : Ms.L.Victoria Gowri Assistant Solicitor General COMMON ORDER The writ of Mandamus has been filed to direct the respondents to issue joining letter to the petitioner in the post of Contable (GD) in CAPFs/NIA/SSF and Rifleman (GD) in Assam Rifles in the year 2018 by considering the petitioners' representation dated 09.04.2022.
2. Admittedly, the petitioners were provisionally selected for appointment to the post of Constable. During verification process, the authorities competent found certain discrepancies in finger prints, signature and handwriting. In order to verify the same, the original documents are sent for Central Forensic Sciences Laboratory for obtaining report regarding the genuinety. Out of 10173 selected candidates, 12 candidates were identified and the verification was sent in respect of those candidates alone. The other candidates were issued with order of appointment.
3. The learned Assistant Solicitor General of India made a submission that the process may take another five months for getting a final report from the Central Forensic Sciences Laboratory and on receipt of the report, all appropriate action will be taken by the respondents for passing necessary orders.
4. The learned counsel for the petitioners drew the attention of this Court that in similar circumstances, some other candidates approached the High Court of Kerala and an order was passed on 06.10.2021 in W.P.(C) No.12732 of 2021 to complete the process as expeditiously as possible.
5. In view of the facts and circumstances, the respondents on receipt of the Central Forensic Sciences Laboratory report has to initiate all appropriate action, finalise the provisional selection 2/3
of the petitioners for appointment to the post of Constable. The said exercise is directed to be done as expeditiously as possible.
