Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Girl Missing case altered into Sections 366(A) and Sections 4 and 5(L) of POCSO Act in Crime No.6 of 2016 on the file of the respondent police, the petitioner/A2 has come forward with this petition seeking anticipatory bail. 2.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent police.

3. The case of the prosecution is that A1 eloped with a minor girl and got married her and this petitioner, being a friend of A1, helped him for their marriage, which resulted in registration of the case.

4. Learned counsel for the petitioner has submitted that A1 was already arrested and released on bail by the Lower Court and the victim was also secured by the respondent police. https://hcservices.ecourts.gov.in/hcservices/

5. Learned Government Advocate (Crl.Side) would submit that as per the provisions of POCSO Act, a person, who helped a minor girl

of below 18 years of age for her marriage, is also liable to be punished under the said Act.

6. Even though A1 was arrested and released on bail, considering the serious nature of the offences alleged against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
