COMMON JUDGMENT (By G.R.SWAMINATHAN, J.) Heard both sides.

2.The case on hand pertains to the affairs of Yadava College, Madurai and Yadhavar Kalvi Nidi Association, Madurai. The appellants question the election process that took place recently and also Form VII that was filed before the District Registrar. 3.We are clearly of the view that these matters will have to be necessarily agitated only before the jurisdictional Civil Court. In writ proceedings, such factual disputes cannot be gone into. The appellants are also agreeable to take recourse to Civil Court. 4.One of the appellants also questioned the decision of the Director of Collegiate Education permitting R.V.N.Kannan to function as Secretary of the college committee.

5.The appellants agree to join together and file a comprehensive suit before the Principal District Court, Madurai within a period of three 5/8

weeks from the date of receipt of a copy of this judgment. If the papers are in order, the same shall be numbered immediately and taken on file. The persons who will be named as defendants in the suit have been shown as respondents in the present proceedings. Copies of the plaint will be served in advance on the respondents and respondents herein undertook to enter appearance before the trial Court even without waiting for formal service of summon. The suit itself shall be disposed of on merits and in accordance with law within a period of six months thereafter. The learned trial Judge will dispose of the suit uninfluenced by the observations as well as findings rendered by the learned Single Judge. It is needless to say that the society is at liberty to raise all their objections in the written statement including the locus standi of the appellants.
