Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents no. 4 and 5 to complete their enquiry proceedings in OO.Mu. (P10)/59262/2023 dated 21.11.2023 and Na.Ka.A8/4731/2023 dated 07.12.2023 respectively and to cancel wrong entry i.e online FMB Sketch in respect of petitioner's property in Survey no. 158/1A4B in an extent of 50 cents situated at Naripaiyur Village, Kadaladi Taluk, Ramanathapuram District within a time frame fixed by this Court. ORDER

Heard both sides.

2.The petitioner was awarded dealership by Petroleum Corporation. When steps were taken to instal the same, it was discovered that there is an 2/5

error in the online FMB. The manual FMB is in order. To correct the said discrepancy, the petitioner had submitted a petition before the third respondent. The Tahsildar, Kadaladi Taluk, asked to conduct enquiry. The fifth respondent is said to have completed the enquiry. Now the fourth respondent is to carry out survey.

3.The fourth and fifth respondents are directed to complete the work at their end, within a period of four weeks, from the date of receipt of a copy of this order.

4.I am conscious that the fifth respondent will be having election related duties yet I am constrained to give direction because the learned Counsel states that if the rectifying work is not done, his licence may be cancelled. Therefore, I direct the fifth respondent to complete the work as expeditiously as possible. Based on the inputs given by the respondents 4 and 5, the third respondent will pass an appropriate order. This entire exercise shall be completed within a period of six weeks, from the date of receipt of a copy of this order.

5.With the above direction, this writ petition is disposed of. No costs. 28.03.2024 NCC : Yes / No Index : Yes / No Internet : Yes/ No LR Note:Issue order copy on 01.04.2024.
