This petition has been filed to cancel the anticipatory bail granted to the second respondent herein in Crl.O.P(MD) No.11556 of 2022 dated 21.06.2023. 2.The case of the prosecution is that A1 has received a sum of Rs.9,23,000/- from the defacto complainant and his friends for arranging job in Croatia Country, but as per the promise, he did not arrange job to them and had not repaid the money and cheated them. Hence, the case.
3.The learned counsel appearing for the petitioner submitted that the second respondent/accused undertook before this Court that he would settle the entire amount to him. However, the second respondent/accused failed to honour the same and therefore, he prayed to cancel the anticipatory bail granted to the second respondent/accused.
4.The learned Government Advocate (Crl. Side), on instructions, submitted that the second respondent/accused has paid Rs.3,30,000/- and the remaining amount to be paid is Rs.5,93,000/-.
5.Since a part amount has already been settled, this Court is not inclined to 2/3
interfere at this juncture. Accordingly, this Criminal Miscellaneous Petition stands dismissed.
