ORDER

The petitioner seeks for a direction to the respondent to consider the appeal filed by him on 06.08.2015, challenging the patta proceedings.

2. It is submitted by Mr.S.Kumar, learned Additional Government Pleader appearing for the respondent that the petitioner has to only approach the Revenue Divisional Officer of Thiruchirappalli, he being the Appellate Authority and on the other hand, the appeal preferred before the respondent, who is the District Revenue Officer/Revisional Authority is not maintainable.

In any event, as the appeal is said to have been filed before the District Revenue Officer, Thiruchirappalli, I only direct the District Revenue Officer, Thiruchirappalli to forward such appeal to the Revenue Divisional Officer, Thiruchirappalli for him to consider such appeal and pass orders on the same on merits and in accordance in law. Needless to say that the Appellate Authority, namely the Revenue Divisional Officer, shall dispose of such appeal, after affording an opportunity of hearing to the petitioner and other interested parties, if any.

Accordingly, the respondent is directed to forward the appeal presented by the petitioner on 06.08.2014 to the Revenue Divisional Officer, Thiruchirappalli within a period of two weeks from the date of receipt of a copy of this order. On receipt of such appeal, the Appellate Authority, namely the Revenue Divisional Officer, Thiruchirappalli shall pass orders on the same on merits, after giving due opportunity of hearing to all the parties concerned, within a period of twelve weeks thereafter.

5. With the above directions, this Writ Petition is disposed of. No costs.
