To Suspend the sentence imposed on the petitioner vide judgment dated 02.06.2025 in S.C. No. 64 of 2017 on the file of the learned I Additional District and Sessions Judge, Thoothukudi and enlarge the petitioner on bail.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed by the petitioner seeking for suspension of sentence imposed in the judgment dated 02.06.2025 made in S.C. No. 64 of 2017 on the file of the learned I Additional District and Sessions Judge, Thoothukudi and to enlarge the petitioner on bail.

2. Heard the learned counsel on either side.

3. This is the second petition filed by the petitioner seeking for suspension of sentence. The earlier petition filed in Crl.M.P.(MD).No. 9708 of 2025 came to be dismissed by an order dated 06.01.2026 as withdrawn. However, on going through the order, it is seen that the Court was not inclined to grant suspension of sentence and at that point of time, the petition was withdrawn. In view of the same, the same has to be construed as dismissed on merits.

4. Since we do not find any change in circumstances, we are not inclined to entertain this petition and accordingly, this petition stands dismissed.
