ORDER

This petition is filed for a direction to the learned Judicial Magistrate No.II, Fast Track Court, Madurai, to complete the trial in STC.No.24 of 2016, within a time limit.

2.Heard the learned counsel for the petitioner and perused the materials available on record.

3. Mr.K.Muthumalai, learned counsel for the petitioner would submit that the petitioner is the complainant in a private complaint filed under Section 138 of Negotiable Instruments Act for dis-honour of cheque, to the tune of Rs.81,50,000/-. It is further submitted that originally the case was filed before the learned Judicial Magistrate, Rajapalayam, in the year 2015 and subsequently transferred to the learned Judicial Magistrate No.II, Fast Track Court, Madurai, and renumbered as STC.24 of 2016.

4.The learned counsel would further submitted that the trial had commenced on 12.07.2016 and on that day PW1 was examined in chief and he has marked Ex.P1 to P18. Subsequently, the case was adjourned to 18.07.2016, 01.08.2016, 10.11.2016 and 18.11.2016, but there is no substantial progress in this case and the accused has been taking adjournments without any valid reason. It is further submitted that the complainant is entitled for speedy disposal of the case as guaranteed by the Constitution of India.

Madurai, is directed to dispose of the case in STC.No.24 of 2016, as expeditiously as possible, preferably within a period of four months from the date of receipt of a copy of this order.
