PRAYER :- For Bail in Crime No.76 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 24.03.2021 for the alleged offences punishable under Sections 174(3) Cr.P.C., altered into Sections 323, 302 IPC in Crime No.76 of 2021, seeks bail. 2.The case of the prosecution is that the petitioner and other accused attacked the defacto complainant's father and caused the death of the father of the defacto complainant. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution. He further submitted that the deceased in this case was suffered from various illness and the petitioner and other accused are not responsible for the death of the deceased.

4.The learned Government Advocate(Crl.side) appearing for the respondent police strongly opposed this petition on the ground that https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD)No.5938 of 2021 the case was registered only on 17.03.2021 and investigation is pending.

5.Considering the nature of the case and the fact that the investigation is in preliminary stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
