The Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, to withdraw the IDOP NO.93 of 2022 on the file of the Principal District Court, Sivagangai, and transfer the same to the Family Court, Madurai to be tried along with M.C.No.120 of 2023. ORDER

The petitioner is the wife. She is now praying to withdraw the IDOP.No.93 of 2022 on the file of the Principal District Court, Sivagangai and transfer the same to the file of the Family Court, Madurai. She has filed MC.No.120 of 2023 and the same is also pending before the Family Court,

Madurai. She is also residing within the jurisdiction of the Family Court, Madurai.

2.Being satisfied with the reasons mentioned in the affidavit filed in support of the application, the Transfer Civil Miscellaneous Petition is ordered on the following terms:

(i)the IDOP.No.93 of 2022 on the file of the Principal District Court, Sivagangai, is withdrawn and transferred to the file of the Family Court, Madurai, to be tried along with MC.No.120 of 2023. (ii)No costs. Consequently, connected miscellaneous petition is also closed.
