O R D E R

This Criminal Original petition is filed seeking a direction to the first respondent to instruct the second respondent not to harass the petitioner under the guise of enquiry.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal side) appearing for the respondents 1 and 2.

3. The learned counsel for the petitioner submitted that under the guise of enquiry, the petitioner is harassed by the second respondent police, even though no complaint has been registered.

4. The learned Government Advocate(Criminal side) on instructions submitted that no case was registered, as there was no complaint as against the petitioner.

5. Taking into consideration the rival submissions, this Court is inclined to direct the respondent police not to harass the petitioner with regard to any complaint. Even if the presence of the petitioner is required for any enquiry in future, he will be called only after issuing summons prescribing the date and time and in the manner prescribed in law.

6. With the above observation, the Criminal Original petition is closed.
