Government Advocate (Crl Side) on behalf of the Respondents the court made the following order:- The petitioner seeks cancellation of bail granted in favour of the accused on the ground that anticipatory bail was granted on the premise that the de facto complainant was discharged from the hospital. Actually, when the anticipatory bail was granted the de facto complainant is still in patient, this Court does agree with the petitioner's counsel that an erroneous representation has been made. Be that as it may, the fact remains that as of now the de facto complainant has been discharged from the hospital. The accused did not misuse the liberty granted by this Court in anticipatory bail in favour of the petitioner/accused.
