The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the first respondent to recover a sum of Rs. 2,84,078/-, together with interest at the rate of 12% per annum till the date of realisation, being the award amount in E.C. No.8 of 2023 on the file of the Deputy Commissioner of Labour, by order dated 02.05.2023.
2. The petitioner states that the Deputy Commissioner of Labour, by order dated 02.05.2023, passed an award directing the third respondent to pay the said amount as compensation for the death of the petitioner's husband, who died during the course of his employment. Pursuant to the said award, the second respondent has communicated to the first respondent to recover the amount from the third respondent as arrears of land revenue. The grievance of the petitioner is that the first respondent has not taken any effective steps to recover the said amount. 2/4
3. Mr. P. Subbaraj, learned Special Government Pleader, on instructions, submitted that steps will be taken to recover the amount from the third respondent in accordance with law.
4. Recording the said submission, this Writ Petition is disposed of with a direction to the first respondent to take necessary steps to recover the sum of Rs.2,84,078/-, together with subsequent interest at the rate of 12% per annum, from the third respondent and pay the same to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. No costs.
