Prayer : Civil Miscellaneous Petition is filed to condone the delay of 1 day in filing the Civil Miscellaneous Appeal against the decreetal order and fair order dated 02.02.2024 passed in I.A.No.2 of 2023 in Probate O.P.No.14 of 2023 on the file of the learned Additional District Court (Fast Track Court), Kanyakumari District at Nagercoil.

ORDER

This Civil Miscellaneous Petition has been filed to condone the delay of 1 day in filing the Civil Miscellaneous Appeal in C.M.A. (MD)SR No.37928 of 2024 before this Court.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for the 3rd respondent submitted that the 2nd respondent is the wife of the 3rd respondent, and has undertaken to file a vakalat for the 2nd respondent, and has not raised any objection to allow this petition.

4. Being satisfied with the reasons stated in the affidavit, this Civil Miscellaneous Petition is allowed.
