PRAYER: Criminal Original petition filed under Section 482 of Criminal Procedure Code, to direct the respondent police not to harass the petitioner and her family members on the guise of enquiry and by following due process of law.

O R D E R
This Criminal Original Petition is filed seeking a direction to the respondent police not to harass the petitioner and her family members on the guise of enquiry and by following due process of law.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal Side) appearing for the respondents.
3. The petitioner herself admitted that several cases are pending against her son. However, it is stated that the respondent police made a search in connection with the criminal case pending against the son of the petitioner and threatened her and the family members, even during the night hours. The petitioner also stated that her son is living separately and even the marriage of https://hcservices.ecourts.gov.in/hcservices/
her son was against the wish of the petitioner. In such circumstances, the petitioner cannot be harassed and particularly, asking her to produce her son immediately, is nothing but harassment.
4. However, the learned Government Advocate(Criminal side) submitted that no harassment to the petitioner and she was never called upon to appear for any enquiry.
5. Considering the grievance of the petitioner, this Court direct the respondent police not to harass the petitioner unnecessarily and even if the presence of the petitioner is required in connection with any information that is received by the respondent police, she will be called only after issuing summons prescribing the date and time and in the manner prescribed in law.
6. With the above observations, the Criminal Original petition is closed.
