ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 1 to 6 to grant 100% solatium and 25% incentive in respect of the compensation paid to the petitioner for the acquisition of his property through Sale Deed Document No.2536 of 2016, dated 26.05.2016, on the file of the Sub-Registrar, Manapparai, for the purpose of broadening the

Villupuram-Dindigul Railway line, on par with other landowners who have given their lands for the same purpose, based on the petitioner's representation dated 06.10.2024 submitted to the respondents and in accordance with G.O.(Ms)No. 411, dated 06.08.2020, of the Revenue and Disaster Management Department, Land Administration Wing (LA-I(1)) Section.

The learned counsel for the petitioner submits that the petitioner's property was acquired for the purpose of broadening the Villupuram-Dindigul Railway line through Sale Deed Document No.2536 of 2016, dated 26.05.2016, on the file of the Sub-Registrar, Manapparai. While compensation was paid, the petitioner has not been granted 100% solatium and 25% incentive as provided to other landowners similarly affected. The petitioner made a representation dated 06.10.2024 seeking parity in terms of solatium and incentive in accordance with G.O.(Ms) No.411, dated 06.08.2020, of the Revenue and Disaster Management Department, Land Administration Wing (LA-I(1)) Section. Since the same has not been considered so far, the petitioner has approached this Court by filing the present Writ Petition.

3. The learned Additional Government Pleader appearing for the respondents 5 and 6 would submit that the competent authority is the fifth respondent and that the fifth respondent would pass appropriate orders on merits and in accordance with law within a time frame to be fixed by this Court.

4. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the fifth respondent to consider the petitioner's representation 06.10.2024, on merits and pass appropriate orders in accordance with law after providing reasonable opportunity of hearing to the petitioner and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order.
