Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the Respondents herein to provide adequate police protection to the Petitioner for putting up fencing in respect of her landed properties comprised in S.Nos.5/2B, 5/3A and 5/3B situated at Kuraur Bit II Village, Kallikudi Taluk, Madurai District on the basis of the Petitioner's representation dated 23.03.2024 in accordance with law within a time stipulated by this Court.

ORDER

The learned Counsel for the Petitioner submits that the Petitioner had filed this petition seeking direction against the Respondents for police protection to fence the property, patta land belonging to the Petitioner, for which the revenue authorities had identified the properties and surveyed the same with regard to the revenue records as well as the records relating to the Petitioner. The Petitioner had enclosed the copies of the proceedings and the revenue records regarding the same. The learned Counsel for the Petitioner relied on the earlier order passed by this Court in W.P.(MD) No.25354 of 2023 dated 19.10.2023. Also, he relied on the proceedings of the Tahsildar, Kallikudi dated 16.10.2023. 2.The learned Government Advocate (Crl.side) submits that the Petitioner may be directed to pay the necessary charges. Also, he would submit that considering the present model code of conduct, the police are facing shortage of men. Therefore, after the election, they are ready to comply with any of the conditions to be imposed by this Court.

3.Considering the submissions of the learned Counsel for the Petitioner and the learned Government Advocate (Crl.side), the Respondents are directed to extend the police protection to the Petitioner as per the proceedings of the Tahsildar, Kallikudi dated 16.10.2023, since the survey and marking of the boundaries had been completed by the Officials of the Survey and Revenue Department. The Petitioner is directed to pay necessary charges as per the circular of the Director General of Police, Head of State Police Force, Chennai-4, issued in Rc.No.193784/PAC-2/2017, dated 19.03.2019 for deployment of police personnel on duty for fencing the property. The Respondents are directed to carry out the same within a period of two months from the date of receipt of a copy of this order.

With the above directions, this Writ Petition is disposed of. No costs. 26.03.2024 Index : Yes / No Internet : Yes / No mm 3/5
