ORDER

The petitioner is the President of a registered Farmers' Association in Trichy District. He has filed this writ petition seeking a direction to the respondents/Vigilance and Anti-Corruption to conclude the investigation in Crime No.5 of 2025 on the file of the 3rd respondent.

The learned counsel appearing for the petitioner submitted that the case in Crime No.5 of 2025 was registered by the 3rd respondent based on the complaint given by the petitioner that the Joint Director and Deputy Director of Agriculture Department, Trichy District, have procured Farm Implement Kits to the extent of Rs.2,25,00,000/- without following the procedures and without getting permission from the 2/7

District Level Agricultural Procurement Committee. Though the case was registered in the year 2025, the same is pending without any progress. Therefore, the petitioner has filed this petition seeking a direction to the respondent Police to file the final report within a stipulated time.

3. The learned counsel for State of Tamil Nadu (Crl. Side) has filed a status report and submits that the complaint of the petitioner was registered in Crime No.5 of 2025 for the offence under Section 13(1)(c) and 13(2) of the Prevention of Corruption Act and Sections 420, 409 r/w. 34 IPC. They have conducted investigation, examined 408 witnesses including 357 beneficiaries and also verified 26 documents. During the investigation, they found that Farm Implement Kits were purchased and they were also delivered to the respective beneficiaries.

4. The Investigating Officer, in her status report, stated that in order to ascertain the quality of the materials supplied by the Agricultural Department to the farmers, they have collected an expert report from Anna Engineering University, Trichy, wherein, the Experts have stated 3/7

the majority of the inspected items confirmed to the specified dimensions and material requirements and there is no material defects and deficiencies affecting the functional performance or usability of the items. However, the Farm Implement Kits were procured without obtaining approval from the District Level Agricultural Procurement Committee. Therefore, they have submitted the final report to the Director of Vigilance and Anti-Corruption Department for approval on 16.06.2026.

5. This Court considered the rival submissions made and also perused the materials placed on record.

6. The petitioner has filed this writ petition seeking a direction to the respondents/Vigilance and Anti-Corruption Department to conclude the investigation in Crime No.5 of 2025. The 3rd respondent submits that they have concluded the investigation and also filed the final report on 16.06.2026 for the approval of the Director of Vigilance and AntiCorruption Department. 4/7

7. The learned Counsel for State of Tamil Nadu (Crl. Side) submits that this report would be forwarded to the Vigilance Commissioner and after the approval of the Vigilance Commissioner, a decision would be taken by the Government with regard to further course of action.

8. Since the investigation has been completed and final report has also been sent for approval of the Vigilance Commissioner and for the Government, this writ petition is closed. However, the 3rd respondent is directed to furnish a copy of the final report along with the decision of the Government and the Vigilance Commissioner, to the petitioner enabling him to workout his remedy in the manner known to law. 22.06.2026 ogy Index : Yes / No.
