Respondents PRAYER:- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the Respondent NO.1 to expedite the enquiry upon the petitioner application dated 14.06.2013 seeking alteration of date birth as 13.03.1974 instead of 18.03.1972 in the service register in accordance with Section 59 of Tamil Nadu Government Servants (Conditions of Service) Act, 2016 considering the representation of the petitioner dated 10.02.2026 within the time period stipulated by this Court. ORDER
With consent of both parties this writ petition is taken up for disposal at the admission stage itself.
2. Heard the learned counsel for the petitioner and Mr.N.Satheesh Kumar, learned Additional Government Pleader appearing for the respondents.
3. The case of the petitioner is that immediately after he joined service as PG Assistant, he made a request for the change of his date of birth from 13/3/1974 instead of 18/3/1972 and in terms of Section 59 of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, the said request of the petitioner is required to be considered by the respondents and appropriate action need to be taken.
4. As no action was taken by the Chief Educational Officer, the petitioner on earlier occasion approached this Court by filing W.P (MD)No. 21014 of 2025 and the said writ petition was disposed of by an 2/5
order dated 01.08.2025 directing the Chief Education Officer concerned to process the application of the petitioner and accordingly, the second respondent, through the proceedings in Na.Ka.No.064060/WP2/E2/2025 dated 10.12.2025 submitted the necessary proposal to the first respondent.
5. The grievance of the petitioner is that the first respondent, having received the proposal from the second respondent, has not taken any action on the said proposal as on date. Hence petitioner approached this court by filling the present writ petition.
6. Mr.N.Satheesh Kumar, learned Additional Government Pleader submits that the first respondent would take an appropriate decision on the proposal submitted by the second respondent date at 10.12.2025 as expeditiously as possible in terms of Section 59 of the Act, 2016.
7. In the light of the above, without going into merits of the matter, this writ petition is disposed of directing the first respondent to take appropriate action pursuant to the proposal submitted by the second 3/5
respondent vide proceedings in Na.Ka.No.064060/WP2/E2/2025 dated 10.12.2025 as expeditiously as possible at any rate within a period of three months from the date of receipt of a copy of this Order. No costs. 24.03.2026 CM TO
