O R D E R

The writ petition has been filed praying this Court for issuance of a Writ of Mandamus directing the 2nd respondent to conduct the tender process in pursuance of the notification Na.Ka.No.441/2015 dated 13.7.15 in a transparent manner by permitting the petitioner also participate in the same.

2.Today, when the matter is taken up for hearing, learned Government Advocate has submitted that already auction was conducted on 31.07.2015 and confirmation order was also issued in favour of the third respondent.

3.Since already confirmation order was issued in favour of the third respondent, this writ petition has become infructuous. Accordingly, the writ petition is dismissed. However, liberty is given to the petitioner to challenge the confirmation order dated 31.07.2015, if so advised. No costs. Consequently, connected Miscellaneous Petition is also dismissed.
