Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SIVASUBRAMANINAN.S, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate(Crl.side)on behalf of the Respondent, the Court made the following order:- This Criminal Miscellaneous Petition has been filed to modify the condition imposed in paragraph No.6 in Crl.O.P.(MD)No.3560 of 2024, dated 08.03.2024. 1/3
2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. side) appearing for the State. 3.The learned counsel appearing for the petitioners would submit that this Court by order dated 08.03.2024, granted anticipatory bail to the petitioners by imposing condition that the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned. Since the petitioners are not in a position to produce four sureties, they filed the present petition for modifying the above said condition.
4.In view of the above, the condition imposed on the petitioners in Crl.O.P (MD)No.3560 of 2024, dated 08.03.2024 in Paragraph No.6 is hereby modified to the effect that "the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each, with one surety, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned". The time for execution of sureties is extended by two weeks from the date of receipt of a copy of this order. 2/3
