ORDER

This writ petition has been filed by S.Jessima Begum challenging the impugned result proceedings issued by the respondent in the petitioner's enrolment No.7100051 and directing the respondent to permit the petitioner to complete the recruitment process for the post of Sub Inspector of Police.

2. Mrs.S.Bharathi, learned Government Advocate takes notice for the respondent.

3. By consent, this writ petition is disposed of at the stage of admission.

The learned counsel for the petitioner has submitted that the petitioner has completed B.Sc., Degree and now working as Woman Police Constable - Grade - I - 167 in All Women Police Station, Tanjore. The petitioner has applied for the post of Sub Inspector of Police through service quota and her Enrolment Number is 7100051. Subsequently, on 24.05.2015 written examination was conducted and the petitioner scored 41.5 marks.

The learned Government Advocate, at this juncture has brought to the notice of this Court that the communication issued by the respondent shows that the petitioner has secured 41.5% marks in the written examination and Enrolment Number is 7100051 and the remarks thereon shows that she has scored marks below the relevant cut-off marks. But to disprove the stand taken by the respondent, again the learned counsel for the petitioner has brought to the notice of this Court that the petitioner has secured 41.5 cut off marks, but the cut off marks prescribed by the respondent for Background Community Muslim - woman - service candidate category is only 33.5.

6. The communication sent by the respondent which is annexed in page No.8 of the typed set also shows that the petitioner has secured 41.5 cut off marks. However, having erroneously mentioned in the said communication that the petitioner has scored the marks below the relevant cut-off, when the notification fixed the cut off mark for the department quota for Backward Community as 33.5, she should have in all fairness been permitted to participate in all the tests. Therefore, the petitioner is permitted to take part in physical test, scheduled to be held on 03.08.2015 to 05.08.2015. The learned Government Advocate is also directed to inform the name of the petitioner for her participation.
