ORDER : The Court Made the following order :- The petitioners, who were arrested and remanded to judicial custody on 19.10.2016, for the offences punishable under Sections 120(b) and 302 of IPC., and Sections 25(1B)(g), 27(1) of Indian Arms Act, in Crime No.607 of 2016, on the file of the respondent police, seek bail.

2. The learned counsel for the petitioners states that the petitioners in this case are A5 and A3 respectively. A5 is the wife of A1. The deceased said to have murdered the son of A1 and A5. He would further submit that as per the confession statement of A1, the other accused are implicated in this case and the petitioners are innocent.

3. The learned Government Advocate (crl.side) appearing for the respondent states that because of the enmity, retaliation murder has been done by the accused. He would further submit that the Gun used in the occurrence was handed over to A2 by A1 and thereafter, it was handed over to A3 by A2. The petitioners were arrested and they are in custody from 19.10.2016 onwards.

4. Considering the above facts and circumstances of the case and also the murder is for retaliation due to previous enmity, this Court is not inclined to grant bail to the petitioners, at this stage. Hence, the petitions are dismissed.
