When the matter was taken up for hearing on 30.01.2017, there was no representation on behalf of the petitioner and therefore, the case was directed to be posted on 07.02.2016 under the caption "For Dismissal" Even today, neither the petitioner nor his counsel is present in this Court to prosecute the case.

3. Therefore, this Criminal Original Petition is dismissed for non prosecution. Consequently, connected miscellaneous petition is also dismissed.
