This Criminal Original petition has been filed to direct the first respondent to withdraw the case in Crime No.99 of 2017 pending on the file of the respondent No.3 and entrust the same to https://hcservices.ecourts.gov.in/hcservices/
the respondent No.2 for fair investigation and to file the final report within a time frame.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal side) appearing for the respondents.
3.The learned counsel for the petitioner stated that the third respondent police has registered a false case against the petitioner in Crime No.101 of 2017 and the third respondent, without considering the statement of the petitioner properly, registered the case in Crime No.99 of 2017 not for offences under Sections 3(1) (r), 3(1) (s) of SC/ST (POA) Amendment Act 2015, though such offences are made out.
4.The learned Government Advocate (Crl.Side), on instructions, submitted that pursuant to the complaint, enquiry was conducted and after proper investigation, final report was filed in C.C.No.214 of 2014 on the file of learned Judicial Magistrate, Vallioor, Tirunelveli.
5.Having regard to the fact that the investigation is already over and it is stated that the case has been taken on file in C.C.No.214 of 2014 on the file of learned Judicial Magistrate, Vallioor, Tirunelveli, this Criminal Original Petition is closed with liberty to seek appropriate relief, if required, in accordance with law.
Consequently, connected miscellaneous petition is closed.
